Under the original (TCJA) program, deferred gains are recognized by December 31, 2026, and those zone designations sunset at the end of 2026.
The OBBBA made Opportunity Zones permanent, with a new program beginning in 2027: new zone designations, a rolling 5-year deferral, and a basis step-up of 10% (30% for rural zones).
Investments held 10+ years can still owe no tax on the fund's own appreciation.
